By accessing or using the Novalumic website (www.novalumic.com), platform, or related services (collectively, the “Services”), you agree to be bound by these Terms & Conditions (“Terms”).

If you do not agree, please do not access or use the Services. If you are accepting these Terms on behalf of an organization, you represent that you have the authority to bind that organization.

You must be at least 18 years old to use the Services, or the age of majority in your jurisdiction. By using the Services, you represent that you meet these requirements and have the legal capacity to enter into these Terms.

You agree to use the Services lawfully and responsibly. You will not:

• Use the Services for unlawful, fraudulent, or harmful purposes
• Interfere with or disrupt the Services or related infrastructure
• Attempt to access areas, accounts, or data you are not authorized to access
• Reverse engineer, decompile, or extract source code except where allowed by law
• Misuse, copy, or redistribute Novalumic content without authorization

Certain features require an account. You agree to provide accurate information, keep your credentials secure, and notify us immediately of any unauthorized use. You are responsible for activity that occurs under your account.

The Services, including all software, designs, logos, content, and documentation, are owned by Novalumic or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms.

You retain ownership of the content and data you submit to the Services. You grant Novalumic the rights necessary to host, process, and provide the Services using that content.

We work to provide reliable, high-availability Services and offer SLA-backed availability on eligible plans. From time to time, the Services may be unavailable due to scheduled maintenance, upgrades, or events beyond our reasonable control.

The Services may contain links to, or integrations with, third-party websites and services. Novalumic is not responsible for the content, policies, or practices of third parties. Your use of third-party services is at your own risk and governed by their terms.

We do not warrant that the Services will be uninterrupted, error-free, or completely secure. Your use of the Services is at your own risk.

To the maximum extent permitted by law, Novalumic and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid to Novalumic for the Services in the 12 months preceding the claim.

You agree to defend, indemnify, and hold harmless Novalumic and its affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services or violation of these Terms.

Our handling of personal information is governed by our Privacy Policy. By using the Services, you acknowledge and agree to our privacy practices.

We may suspend or terminate your access to the Services if you breach these Terms or if continued provision of the Services becomes impracticable. You may terminate your account at any time.

Upon termination, your right to use the Services ceases, and any provisions of these Terms that by their nature should survive termination will remain in effect.

These Terms are governed by the laws of India, without regard to its conflict of laws principles. The courts located in Kerala, India shall have exclusive jurisdiction over any disputes arising under these Terms, except where otherwise required by mandatory local law.

We may update these Terms from time to time. When we make material changes, we will notify you through the Services or by other reasonable means. Continued use of the Services after a change becomes effective constitutes acceptance of the updated Terms.
